These Terms and Conditions ("Terms") govern the relationship between XenonHost.ro ("the Provider", "we") and you ("the Client", "user") regarding the use of web hosting services, domain registration, and related services offered through the xenonhost.ro website.

By accessing our website and/or purchasing any service, you confirm that you have read, understood, and accepted these Terms in their entirety. If you do not agree with any of these provisions, please do not use our services.

XenonHost.ro offers the following categories of services:

• Shared hosting: shared hosting space on optimized servers, with resources allocated according to the selected plan.
• VPS servers: virtual private servers with dedicated resources and full root access.
• Dedicated servers: dedicated physical servers with customizable configurations.
• Domain registration: registration and management of domain names through accredited registrars.
• WordPress hosting: hosting specifically optimized for the WordPress platform.
• PrestaShop hosting: hosting optimized for PrestaShop online stores.
• SSL certificates: security certificates for connection encryption.

By using our services, you agree to the following obligations:

• Provide accurate, complete, and up-to-date contact information when creating your account.
• Maintain the confidentiality of your access credentials (username, password, SSH keys) and notify us immediately in case of unauthorized use.
• Use the services in compliance with applicable Romanian and European legislation.
• Not use the services for illegal activities, including but not limited to: malware distribution, phishing, spam, or copyright infringement.
• Comply with the Acceptable Use Policy available on our website.
• Perform regular backups of your own data and content.
• Not abusively exceed the resources allocated under your contracted plan.

The following financial conditions apply to our services:

4.1. Pricing and Billing

• Prices displayed on the website include VAT, unless otherwise specified.
• Billing is done in advance for the selected service period (monthly, quarterly, semi-annually, or annually).
• Invoices are issued electronically and sent to the email address associated with the account.

4.2. Payment Methods

• Credit/debit card (Visa, Mastercard)
• Bank transfer
• Other payment methods available at the time of purchase

4.3. Late Payments

• Invoices are due on the date of issue or the date specified on the invoice.
• If payment is not made within 7 days of the due date, the service may be suspended.
• If payment is not made within 30 days of suspension, the account and associated data may be permanently deleted.

4.4. Refund Policy

We offer a 14-day money-back guarantee for shared hosting and WordPress hosting services, from the date of service activation. This guarantee does not apply to domain registration services, SSL certificates, and custom services.

XenonHost.ro commits to the following service levels:

5.1. Uptime Guarantee

We guarantee a network and infrastructure availability of 99.9% per calendar month, excluding scheduled maintenance periods.

5.2. Scheduled Maintenance

• Scheduled maintenance will be announced at least 24 hours in advance via email and/or website announcements.
• Efforts will be made to schedule maintenance during low-traffic periods.

5.3. Compensation

If availability falls below 99.9% in a calendar month (excluding scheduled maintenance), the client may request a credit proportional to the downtime duration, applicable to the next invoice. The maximum credit shall not exceed 30% of the monthly value of the affected service.

5.4. Technical Support

• Technical support available via ticket system and email.
• Estimated response time: under 2 hours for critical issues, under 12 hours for general inquiries.

To the maximum extent permitted by applicable law:

• XenonHost.ro shall not be liable for indirect, incidental, special, consequential, or punitive damages resulting from the use or inability to use the services.
• XenonHost.ro's total liability for any service-related claim shall not exceed the amount paid by the client for the respective service in the preceding 12 months.
• We are not responsible for data loss caused by the client's actions or inactions, including failure to maintain backups.
• We are not responsible for interruptions caused by force majeure, including but not limited to: natural disasters, large-scale cyber attacks, utility provider outages, or legislative changes.

7.1. By the Client

• You may request cancellation of any service at any time from the control panel or by contacting support.
• The service will remain active until the end of the current billing period.
• No refunds are granted for the remaining unused period, except for the 14-day guarantee mentioned above.

7.2. By XenonHost.ro

• We reserve the right to suspend or terminate services in case of violation of these Terms or the Acceptable Use Policy.
• In case of severe violations (illegal activities, security threats), suspension may be immediate, without prior notice.
• For other violations, we will issue a notification with a reasonable remediation period (minimum 48 hours) before suspension.

• The content of the XenonHost.ro website (text, images, logos, design) is protected by copyright law and is the property of XenonHost.ro.
• The client retains all intellectual property rights over the content they host on our servers.
• The client warrants that they hold the necessary rights over the content they host and that it does not infringe upon the rights of third parties.

These Terms are governed by and construed in accordance with the laws of Romania. Any dispute arising from or in connection with these Terms shall first be resolved amicably. If an amicable resolution is not possible, the dispute shall be submitted to the competent courts in Romania.

If any provision of these Terms is declared void or unenforceable, the remaining provisions shall remain valid and applicable.

XenonHost.ro reserves the right to modify these Terms at any time. Changes will be published on this page and, in the case of significant modifications, clients will be notified via email at least 30 days before the changes take effect. Continued use of the services after the changes take effect constitutes acceptance of the new Terms.
